Abstract

Law does not only create rights and duties, but has expressive functions, too. Migration law is a particularly fertile ground for the expressive use of law; in fact, some of it cannot be properly understood without account of its expressive dimension. The paper gives examples in Austrian law, suggests a number of general explanations for them and discusses various ways to deal with expressive harm in judicial review.
