The present paper explores the Austrian discourse on moral persons as addressees of genuinely national fundamental rights provisions. It does so with a specific focus on moral persons under private law. The core argumentative patterns emerging from the relevant case law and pertinent scholarly contributions across constitutional, civil, and corporate law are to be highlighted and systematised.
